These terms govern your use of the TDN Radio Caribbean mobile application (“the app”), published by G & D Enterprises Inc (“we”, “us”). By installing or using the app you agree to them. If you do not agree, please uninstall the app.
1. What the app is
The app streams the TDN Radio Caribbean live radio service and provides access to the program schedule, articles from tdnradio.net, an equalizer, a sleep timer and an optional wake-up alarm. It is provided free of charge and is supported by advertising.
The app requires an internet connection. It is not a downloadable music service and does not provide offline playback.
2. Your license to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your own private, non-commercial listening.
You may not:
- Copy, modify, translate, decompile or reverse engineer the app, except where that right cannot lawfully be restricted
- Record, capture, rebroadcast, retransmit or redistribute the audio stream, in whole or in part
- Extract, scrape or republish the program schedule or article content
- Circumvent, disable or interfere with any security or advertising feature
- Use the app in any way that damages, disables or overburdens our services
- Use automated systems to access the app or the underlying streams
3. The alarm feature, and its limits
Please read this section carefully.
The app includes an optional alarm that starts the live radio stream at a time you choose. It is a convenience feature of a radio app. It is not an alarm clock, and you should not rely on it for anything that matters.
An alarm in this app can fail to sound for reasons outside our control, including but not limited to:
- Your phone restricting background activity or battery usage for the app
- Manufacturer power management, which varies widely between brands and frequently stops third-party alarms
- The device being switched off, out of battery, or in a mode that suppresses sound
- Loss of internet connectivity at the scheduled time, since the alarm plays a live stream rather than a stored file
- Android permissions being denied, revoked or reset
- Operating system updates changing background behavior
Do not use this feature as your only means of waking for work, travel, medication, childcare or any other time-critical obligation. Use your phone’s built-in clock app or a dedicated alarm clock for anything important, and treat this feature as a pleasant extra rather than a dependable one.
To the fullest extent permitted by law, we accept no liability for any loss, missed appointment, missed transport, financial loss or other consequence arising from an alarm that does not sound, sounds late, or stops early.
4. Content and intellectual property
All content delivered through the app, including audio programming, station branding, logos, the program schedule, articles, photographs and the app itself, is owned by G & D Enterprises Inc or its licensors and is protected by copyright and other laws.
Music and other third-party material broadcast on the station is licensed to us for broadcast. That license does not pass to you. Listening does not give you any right to copy, record or redistribute it.
Nothing in these terms transfers any ownership to you.
5. Advertising
The app is free and is paid for by advertising. Adverts are supplied by Google AdMob and are not selected, endorsed or vetted by us. We are not responsible for the content of any advert or for anything you buy or agree to as a result of one. Any dealing with an advertiser is between you and them.

6. Data charges
Streaming audio uses mobile data. You are responsible for any charges your network operator applies. If you are on a metered or limited plan, consider listening over Wi-Fi.
7. Availability
We try to keep the station and the app running continuously, but we do not promise uninterrupted service. Broadcasting can stop for maintenance, technical failure, weather, power loss, licensing changes or reasons beyond our control. Schedules can change without notice, and the program grid shown in the app may not always reflect a last-minute change.
We may add, change, suspend or remove features at any time, including the alarm, the equalizer, the article reader or the schedule.
8. Third-party links and services
The app links to our website and to social media profiles, and displays articles from tdnradio.net. Where a link takes you outside the app, the destination is governed by its own terms and privacy practices, not ours. We are not responsible for third-party content.
9. No warranty
The app is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the app will be error free, that defects will be corrected, that it will be compatible with your particular device, or that the schedule, article content or now-playing information will always be accurate or current.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or opportunity, arising from your use of or inability to use the app.
Where liability cannot lawfully be excluded, our total liability to you is limited to the amount you have paid us for the app, which is zero, or the minimum amount permitted by applicable law.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
11. Your statutory rights
If you are a consumer, these terms do not affect any rights you have under the consumer protection law of your country that cannot be waived by agreement.
12. Indemnity
You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal costs, arising from your misuse of the app, your breach of these terms, or your infringement of any third-party right.
13. Suspension and termination
We may suspend or end your access to the app at any time if you breach these terms or if we discontinue the service. You may end this agreement at any time by uninstalling the app.
14. Changes to these terms
We may update these terms as the app changes. The effective date at the top will change when we do. Continuing to use the app after an update means you accept the revised terms.
15. Governing law
These terms are governed by the laws of the state of Delaware, United States have exclusive jurisdiction, without affecting any right you have to bring proceedings in your country of residence where consumer law gives you that right.
16. Severability
If any provision of these terms is found unenforceable, the rest remains in force.
